1. Data Controller

VantagePen AI operates in full compliance with GDPR (EU 2016/679) and the EU AI Act (Regulation 2024/1689).

2. Nature of the Service

VantagePen AI is an automated generative AI assistant for corporate executives operating exclusively via the WhatsApp Business Cloud API. In accordance with EU AI Act transparency directives (Article 50), users are informed that all interactions involve communication with an automated AI system, not a human writer.

3. Data Collected

  • Contact data — Mobile phone number via WhatsApp Business Cloud API.
  • Communication data — Text messages, voice notes, and writing samples for stylistic vectorization and draft generation.
  • Subscription & billing data — Tier status, Stripe email, payment metadata, trial activation timestamp.
  • Derived stylistic data — The Style DNA: a JSON object across 4 vectors (Syntax & Cadence, Lexicon, Narrative Angle, Format & Layout).

4. Legal Basis

  • Explicit consent (GDPR Art. 6(1)(a)) — for communication data, voice data, and derived stylistic data.
  • Contract performance (GDPR Art. 6(1)(b)).
  • Legitimate interest in billing and fraud prevention via Stripe (GDPR Art. 6(1)(f)).

5. Confidentiality Standards

  • No LLM training — Inputs are never used to train or fine-tune any third-party model. All processing uses enterprise APIs with explicit no-training clauses.
  • Transient voice processing — Voice files are transcribed via OpenAI Whisper and purged immediately after execution. No audio is permanently stored.
  • EU-resident infrastructure — All data stored on encrypted servers within the EU (Supabase EU region).
  • Data minimization — Only derivative outputs required for personalization are persisted. All raw inputs are transient.

6. EU AI Act Compliance

  • Disclosure — Users are informed at onboarding they are engaging with an automated AI system.
  • Content responsibility — Final published content remains the responsibility of the user as author and publisher.
  • Risk category — VantagePen AI is classified as "limited risk" under the EU AI Act. It does not perform biometric identification, credit scoring, or employment decisions.
  • Human oversight — All drafts are returned to the user for review before publication. The user retains full editorial control.

7. Your Rights under GDPR

You may exercise at any time, free of charge: access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability — receive your Style DNA in JSON (Art. 20), withdrawal of consent (Art. 7(3)), and the right to lodge a complaint with the supervisory authority.

Instant exercise via WhatsApp: Send STOP to halt all messages immediately. Send DELETE MY DATA then confirm with CONFIRM DELETE within 24 hours for permanent anonymization. Note: these commands do not cancel an active Stripe subscription — contact privacy@vantagepen.com for billing.

9. Refund Policy

Executive is billed monthly. Cancel anytime; access continues until the end of the paid period. Refunds for partial months are not provided due to upfront compute costs for Style DNA processing and daily content generation.
